Terms of Service

1. Age and Legal Capacity

You must be at least 13 years old to use Pikrex. Nobody under 13 is allowed to use or access Pikrex. If you're between 13 and 18, your parent or guardian must agree to these Terms on your behalf. Parents are responsible for their teenager's activity on Pikrex.

If you're in the European Economic Area (EEA), you can only use Pikrex if you're old enough to consent to data processing in your country, or if your parent has provided verifiable consent.

2. Accounts and Service Updates

When you connect to Pikrex through Discord, you agree that the information you provide is correct and complete. We may refuse access if we learn that your information is inaccurate. You can stop using Pikrex at any time for any reason.

Using Pikrex may require downloading software to your device (like our iOS app). You agree that we may automatically update that software, and these Terms apply to any updates.

3. Your License to Use Pikrex

The Service, including its design, content, and technology, is protected by intellectual property laws. We grant you a worldwide, non-exclusive, personal, non-assignable, and revocable license to use Pikrex solely for personal, non-commercial purposes.

You may not copy, modify, create derivative works, reverse engineer, or attempt to extract the source code of Pikrex without our written consent. The Pikrex name, logo (flame design), and all related marks are our trademarks.

4. Content and Voice Interactions

Your Content

You retain rights to content you share with Pikrex ("User Content"), but you grant us a non-exclusive, royalty-free, transferable, sublicensable, worldwide license to use, store, display, reproduce, and distribute your User Content for operating and improving Pikrex.

Voice Processing

Your voice interactions are processed in real-time through our AI partners (Google Gemini and Cartesia). Voice recordings are not permanently stored. By using voice features, you consent to this processing as described in our Privacy Policy.

5. Subscriptions and Payments

Subscription Tiers

• Free Tier: Available when 4 or more people join a voice channel
• Solo Voice: Individual use with full features
• Pioneer: Premium features, early access, and priority support

Automatic Renewal

Subscriptions automatically renew until you cancel. Cancel at least 24 hours before your renewal date to avoid charges for the next period. After cancellation, you'll have access through the end of your current billing period.

Refunds

We don't offer refunds for partial periods. If you experience technical issues, please contact support before requesting a refund through your payment provider.

6. Prohibited Conduct

You agree not to use Pikrex to:

• Violate any laws or regulations
• Infringe on intellectual property rights
• Harass, abuse, or harm others
• Share inappropriate, offensive, or illegal content
• Interfere with or disrupt the Service
• Attempt unauthorized access to our systems
• Use Pikrex for emergency services or critical decision making
• Impersonate others or misrepresent your affiliation
• Use automated systems to access Pikrex (bots, scrapers, etc.)
• Circumvent any content protections or geographic restrictions

7. Safety Disclaimer

WE PROVIDE PIKREX "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DON'T GUARANTEE THE ACCURACY OR RELIABILITY OF AI-GENERATED RESPONSES.

We are not responsible for:

• The accuracy or completeness of AI responses
• Decisions you make based on Pikrex conversations
• Misunderstandings or misinterpretations of AI output
• Technical issues affecting voice recognition or synthesis
• Loss of conversation context between sessions

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PIKREX AND ITS AFFILIATES WON'T BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, OR GOODWILL ARISING FROM YOUR USE OF PIKREX.

Our total liability for any claims is limited to $100 or the amount you paid us in the past 12 months, whichever is greater. Some jurisdictions don't allow these limitations, so they may not apply to you.

For EEA consumers: This doesn't apply to damage we cause through gross negligence or willful misconduct, or limit any statutory rights you can't waive.

9. Indemnification

You agree to indemnify, defend, and hold harmless Pikrex, its parent company, and its officers, directors, employees, and agents from any claims, losses, or damages arising from:

• Your use of Pikrex
• Your violation of these Terms
• Your violation of any rights of another party
• Your User Content

10. Intellectual Property and DMCA

We respect intellectual property rights. If you believe content on Pikrex infringes your copyright, please send a DMCA notice to:

Include: (1) your signature, (2) identification of the copyrighted work, (3) identification of the infringing material, (4) your contact information, (5) a statement of good faith belief, and (6) a statement of accuracy under penalty of perjury.

11. Termination

We may suspend or terminate your access to Pikrex at any time for any reason, including violation of these Terms. We'll usually provide notice, but may act immediately for serious violations. Upon termination, your right to use Pikrex ends immediately.

You can stop using Pikrex anytime. To delete your data, contact us at privacy@dragonguider.com.

12. Discord and Third-Party Services

Pikrex operates through Discord and requires certain bot permissions. You must comply with Discord's Terms of Service and Community Guidelines. We're not responsible for Discord's actions or policies.

If you use Pikrex through Apple's App Store, additional terms apply. Apple has no obligation to maintain or support Pikrex. Direct any claims to us, not Apple.

13. Arbitration and Governing Law

For U.S. Users

YOU AND PIKREX AGREE TO RESOLVE DISPUTES THROUGH BINDING ARBITRATION INSTEAD OF COURT, AND YOU WAIVE YOUR RIGHT TO PARTICIPATE IN CLASS ACTIONS.

Any disputes will be resolved through final and binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration will be conducted in San Francisco, California, unless we agree otherwise.

You can opt out of arbitration by emailing opt-out@dragonguider.com within 30 days of first using Pikrex. Include your name and Discord username.

Governing Law

These Terms are governed by California law, without regard to conflict of law principles. If arbitration doesn't apply, disputes will be resolved in San Francisco, California courts.

For EEA consumers: This arbitration clause doesn't apply to you. Disputes will be resolved according to your local laws and courts.

14. Changes to Terms

We may update these Terms at any time. We'll notify you of material changes through Discord or our app. By continuing to use Pikrex after changes, you accept the new Terms. If you don't agree, stop using Pikrex.

15. General Provisions

Assignment

You can't transfer these Terms or your account. We can assign our rights to others. For EEA consumers, you can terminate immediately if we assign these Terms.

Severability

If any part of these Terms is invalid, the rest remains in effect.

No Waiver

Our failure to enforce any right doesn't waive that right.
